Terms & Conditions

By commissioning services, accepting project proposals, or initiating development sprints with SkyMarkDev ("we", "our", or "us"), you ("Client", "you") confirm that you have read, understood, and agreed to be bound by these Terms and Conditions.

If you are entering into this agreement on behalf of a company, business, or other legal entity, you represent and warrant that you hold legitimate legal authority to bind such entity to these provisions. If you do not agree with any part of these terms, you should not commission our services.

SkyMarkDev specializes in rapid digital execution across UI/UX design, custom visual branding, responsive WordPress and Webflow development, and full-stack MVP architecture.

The exact deliverables, sprint schedules, and project specifications are agreed upon in your confirmed project brief, invoice, or Statement of Work (SOW).

• Speed-to-Market Model: Our workflows prioritize rapid execution (such as our 3-week prototype sprint). Milestone delivery schedules are contingent upon prompt client asset delivery and feedback.
• Out-of-Scope Requests: Any features, design revisions, or architectural changes requested outside the confirmed project scope will be evaluated and quoted as a separate sprint or hourly engagement prior to implementation.

Delivering high-velocity, high-standard digital products requires active and predictable communication. To maintain delivery milestones without roadblocks, the Client agrees to:

• Provide all required brand assets, copy, server credentials, and third-party API keys in a timely manner.
• Review milestone presentations and return consolidated feedback within 2 to 4 business days of receipt.
• Acknowledge that client-side review delays exceeding 14 consecutive calendar days without prior notice may cause the sprint to be paused and rescheduled based on team capacity.

Project pricing is structured on a milestone basis, fixed project quote, or ongoing monthly retainer as established in your invoice.

• Upfront Commitment: Dedicated sprints begin immediately once the initial deposit or starting milestone payment has been settled.
• Release of Production Assets: Transfer of live production code, complete Figma design files, admin credentials, and domain cutovers occur upon full receipt of final payment.
• Non-Refundable Work: Because our engineering and design talent is reserved specifically for your sprint, all payments made for completed milestones or billable hours worked are non-refundable.

We believe you should have full ownership over the unique product we engineer for your business:

Client Deliverables: Upon settlement of all outstanding invoices, full intellectual property rights, copyrights, and title for bespoke UI designs, illustrations, brand marks, and custom website code transfer exclusively to the Client.

Agency Tooling: SkyMarkDev retains ownership over our internal libraries, reusable code modules, starter frameworks, and scaffolding tools. The Client receives a perpetual, royalty-free, worldwide license to utilize and modify those components within their project.

Showcase Rights: We reserve the customary industry right to display non-confidential screens, project highlights, and case studies across our agency portfolio and social channels, unless governed by an explicit non-disclosure agreement (NDA).

Modern websites and applications rely on external tools such as hosting providers, WordPress plugins, Webflow workspaces, Stripe payments, and third-party APIs.

SkyMarkDev is not responsible for upstream downtime, service deprecations, or policy changes enacted by third-party vendors. The ongoing costs of third-party software subscriptions, font licenses, and hosting services remain the direct financial obligation of the Client.

We take pride in clean, scalable, standards-compliant work. Every deployment includes a complimentary 14-day warranty period post-launch to resolve any bugs or defects resulting directly from our custom code that falls within the original project scope.

Either party may terminate an active project engagement with 7 business days of written notice. In the event of early termination, the Client remains responsible for all billable hours and milestones executed up to the termination date. Completed files and design states will be handed over following invoice settlement.
